Linda Ressetar represents and advises insurers on contractual and extra-contractual matters involving commercial property, general liability, homeowner’s, auto, professional errors and omissions, and excess/umbrella policies. She has litigated complex insurance coverage actions in state and federal courts involving insurance bad faith, duty to defend, priority of coverage, and additional insured coverage.

Linda has represented commercial and personal lines carriers in a wide range of matters, including disputes arising out of business interruption and loss-of-use claims, catastrophic commercial property claims, and construction defect claims. In addition to coverage litigation, Linda has handled appeals in state and federal courts for a variety of clients.

Representative Experience

Prevailed in Oklahoma Federal Court and subsequent appeal to the Tenth Circuit on coverage action arising out of a Parret claim.

Obtained unanimous defense verdict in property insurance dispute tried in Bowie County.

Obtained defense verdict in Hidalgo County for national insurer involving claims for trespass and breach of the peace.

Prevailed in Texas Federal Court and subsequent appeal to the Fifth Circuit concerning coverage dispute regarding the meaning of “common carrier” in the context of a travel accident policy.

Counseled excess and umbrella insurers regarding policy exhaustion and policy limits disputes.

Represented professional liability insurer in declaratory judgment action to determine whether hundreds of wage and hour claims arose out of a series of related negligent acts constituting a single “Claim” under insured’s policy.

Obtained summary judgment for property insurer in multiple lawsuits arising out of hail and wind storm claims.

Prevailed in Oklahoma Federal Court and subsequent appeal to the Tenth Circuit on declaratory judgment action to determine whether insured’s acts resulting in numerous bodily injury claims constituted one “Occurrence” under general liability policy.

Favorable resolution of numerous lawsuits against property insurer arising out of hail and wind storm claims.
