Houston Attorneys Obtain Motion for Summary Judgment Against $4 Million Claim

Houston partners Cory Reed and Zandra Foley obtained a Motion for Summary Judgment for their client against a $4 million negligence claim. The Texas court determined that the plaintiff, Furniture Procurement Service LLP, needed expert testimony to support its claim against National Container Group LLC.
Background
The lawsuit arose from a fire which occurred in May 2018 in an adjacent warehouse. The Plaintiff claimed property damages of $4 million from heat and smoke damage to its property. However, they were unable to provide expert testimony that the fire and subsequent damages were caused by NCG’s improper storage of chemicals.
Analysis
The court also determined that the Plaintiff wasn’t able to establish negligence or gross negligence because NCG’s insurance provider and the Houston Arson Bureau declared that the cause of the fire was unknown and couldn’t be determined because of the damage. Additionally, time delays and a lack of fire hydrants could also be contributing factors to the fire damages, as well as a lack of knowledge of what ignited the fire.
