Reserving Rights: Best Practices and the Use of Extrinsic Evidence
Apr 16, 2024 • 60 mins
This webinar will discuss the purpose and need for reserving rights and the consequences of failing to reserve rights promptly or adequately, including waiver of coverage defenses and estoppel. The course will also discuss the two general categories of rights that can be reserved (conditions precedent to recovery and defenses of non-coverage) and how to effectively reserve rights, including proper timing, content, and style of the reservation-of-rights letter. Upon completing the course, attendees will better understand the mechanics of denial-of-coverage letters, including appropriate timing and contents, as well as the consequences of improperly denying coverage (i.e., breach of the duty to defend and the duty to indemnify).
