This presentation will provide an overview of the ERISA claims procedure and current trends affecting ERISA litigation in the Eleventh and Fifth Circuits. By attending this course, you will gain a deeper understanding of claims procedure under the ERISA governing regulations and the obligations of claims professions. Additionally, we will examine how bans on discretionary clauses in some states affect the standard of review and how beneficiaries are taking an expansive approach to ERISA’s civil enforcement statute, including bringing claims for breaches of fiduciary duty while also attempting to obtain plan benefits. Finally, we will review recent Eleventh and Fifth Circuit cases., addressing discovery disputes related to the administrative record in cases brought under ERISA’s civil enforcement statute. This course is beneficial to insurance adjusters, managers, and insurance attorneys who handle claims governed by ERISA.
