Austin Partner Wade Crosnoe and Dallas Partner Roger Higgins argued separate cases before the Texas Supreme Court.
In In re K & L Auto Crushers, LLC, No. 19-1022, argued by Mr. Crosnoe on behalf of the Defendants/Relators, the issue is whether the Defendants in a personal injury case can obtain discovery regarding the nonparty medical providers’ reimbursement rates with private insurers and government payers for the medical services and equipment billed to an uninsured Plaintiff.
In the Allstate Insurance Company v. Irwin, No. 19-0855, argued by Mr. Higgins on behalf of Allstate, the issue is whether a declaratory-judgment action is appropriate for such a recovery and whether a declaratory judgment for recovering underinsured-motorist benefits may be used also to recover attorney fees.
