Motion for summary judgment granted in professional liability case
Mar 23, 2022
Houston partner Cory Reed was granted a motion for summary judgment and all the plaintiff’s claims were dismissed with prejudice in a professional liability case.
Background
Plaintiff filed suit against Cory’s client for fraud and breach of contract. In the lawsuit, plaintiff argued their client owed her money for services performed in an embezzlement audit. Cory argued plaintiff did not bring her claims within the allotted limitations period and thus her claims were barred by the statute of limitations.
Analysis
In granting the motion, the Court noted “[w]hile summary judgment is a harsh remedy, it is appropriate here where Plaintiff simply waited much too long to file suit.”
