Defense Verdict After 3 Week, $10M Products Trial

On December 19, 2018, after a three-week trial, Partner Zandra E. Foley won a defense verdict in Suffolk Superior Court, Boston, Massachusetts. Along with W. Curt Webb of Beck Redden, LLP and Bryant J. Spann of Thomas Combs & Spann and, Zandra defended a major respirator manufacturer against product liability claims brought by the estate and family of an asbestos worker who died of mesothelioma. Plaintiffs claimed that the respirator was defective and that the manufacturer failed to adequately warn users. After a day and a half of deliberations, the jury rendered a defense verdict. Plaintiffs, who sought $10M in damages, were represented by the Thornton Law Firm in Boston, Massachusetts.
