Transportation Investigation & First Response
Thompson Coe knows that success in the defense of a trucking case begins at the scene. Recognizing that the trucking industry operates 24/7, each office within the firm is equipped with an Emergency Response Team (“ERT”) composed of attorneys and legal support personnel that are available around the clock to assist our clients with their investigative needs. Our Emergency personnel can be on the scene of an incident or accident shortly after being notified and specialize in the preservation of evidence at the accident scene, maintaining investigative privileges, securing eyewitnesses, and immediate analysis of accident causation. Further, each ERT has the ability to work closely with independent investigators and accident reconstruction engineers when required.
Thompson Coe is one of the handful of law firms with lawyers trained in the use and application of GPS tracking systems used by the trucking industry. These systems can provide crucial evidence pertaining to vehicle speed, location, and drivers' hours of service and are often invaluable in establishing accident facts when used in conjunction with witness accounts.
Thompson Coe understands that trucking companies are regulated by a highly specialized body of rules and regulations promulgated by the Federal Motor Carrier Safety Administration, the Texas Transportation Code, and the Texas Administrative Code. Our attorneys have intimate knowledge of the standards and requirements applicable to intrastate and interstate motor carriers and utilize that knowledge in the successful defense of our clients. Where expert consultation or testimony on these issues is required, Thompson Code works closely with these individuals to ensure the best possible outcome for each claim.
Thompson Coe has experience trying commercial automobile and trucking cases both large and small, and has obtained favorable verdicts and settlements in a wide variety of personal injury, wrongful death, and property damage cases.
Thompson Coe zealously prepares each trucking case as if it were going to be tried. The firm has organized dozens of mock jury presentations for the purposes of researching preferred methods of evidence presentation, data retention, and winning trial tactics. For example, Thompson Coe’s recommendation that a recent trucking case involving allegations of traumatic brain injury be presented to a mock jury allowed the handling attorneys to gather invaluable data that resulted in a favorable settlement to our client in a case with significant potential exposure. Where trial proves necessary, jury consultants and trial presentation vendors are consulted to assist in the presentation of often complicated engineering evidence to juries.
When a Thompson Coe client was subject to a TxDOT Compliance Audit following a fatality collision, they asked Thompson Coe to assist them in challenging questionable findings and significant fines pertaining to record retention and alcohol/controlled substance testing. The attorneys at Thompson Coe successfully contested the TxDOT findings, which resulted in a complete reversal of all fines levied.
Transportation Industry Consultation
In addition to representation in litigation, Thompson Coe can be of immediate assistance in any government audit or investigation by the Texas Department of Public Safety (DPS), U.S. Department of Transportation (DOT), National Highway Traffic Safety Administration (NHTSA), National Transportation Safety Board (NTSB) or other local, state or federal governmental or regulatory entity. The firm has represented trucking companies large and small during and after compliance audits and has successfully overturned the findings of both state and federal regulatory authorities, saving our clients thousands of dollars.
