Solar Panel Installation Webcast
Stephanie Rojo will be co-presenting the Shining Some Light on the Installation of Solar Panels in Deed Restricted Communitieswebcast, with Jospeh Lanza of Vethan Law Firm and Christopher J. Weber of Christopher J. Weber, LLC, on Thursday, March 9 at 12:30 p.m. CT. Below is an overview of the seminar, which has been approved for one hour of Texas CLE credit.
As the push to "go green" gains momentum, states such as Texas are responding with legislation that limits property owners' associations' ability to restrict the installation of solar energy devices. In 2011 the Texas Legislature enacted § 202.010 of the Property Code, which they amended in 2015, spelling out when and how a property owners' association can limit the installation of solar energy devices. This program will discuss issues faced by homeowners, property owners' associations, and solar panel sales and installation companies, posed under the statute.
- Nature of restrictions that may be imposed on the installation of solar energy devices.
- Role of Architectural Control Committees in approving or denying applications to install solar energy devices.
- Proposing alternate site locations for the installation of solar energy panels.
- Amendment of deed restrictions and dedicatory instruments to meet statutory requirements for controlling the installation of solar energy devices in deed restricted communities.
