On December 7, 2021, a federal district court judge in Georgia issued an order blocking the Biden Administration from enforcing President Biden’s Executive Order 14042 nationwide. If you don’t remember, Executive Order 14042 required that certain federal contracts (and their subcontracts) maintain a clause stating that the contractor will comply with all guidance issued by the Safer Federal Workforce Task Force. This guidance included a vaccination mandate for most federal contractor employees. Just the day before the Georgia judge’s order, a federal district court judge in Kentucky issued a similar injunction, however the order only applied within Kentucky, Ohio and Tennessee. The Georgia judge’s order is significantly wider scope and impacts all federal contractors that were otherwise preparing and ready to comply with the Safer Federal Workforce Task Force guidance, including the vaccine mandate.
