OSHA Withdraws the Vaccinate-or-Test ETS

On January 13, 2022, employers with 100 or more employees breathed a collective sigh of relief when the United States Supreme Court blocked OSHA from enforcing the Emergency Temporary Standard (ETS) that mandated employers with 100 or more employees to either (a) require all employees be vaccinated against COVID-19 or (b) require unvaccinated employees to undergo weekly COVID-19 testing while the case proceeded in the lower courts. Though it seemed unlikely the ETS would ever become effective again, the possibility still loomed.
