Kolby Keller is a litigator who represents insurers in contentious bad faith coverage disputes involving commercial and residential property damage litigation. Kolby defends insurance companies through every phase of commercial and residential property litigation, starting before suit is ever filed. His experience evaluating breach of contract and bad faith exposure before litigation helps shape the strategy Kolby deploys to effectively defend his clients.
In law school, Kolby clerked at an insurance defense firm handling third-party defense and subrogation matters, while sharpening his advocacy skills in South Texas College of Law Houston’s nationally ranked advocacy program. He carries that same competitive discipline into the courtroom today.
He also advises clients on complex regulatory matters and serves as a certified mediator, giving him a complete understanding of how disputes are resolved.
Representative Experience
Experience researching certificate of merit statutes in all 50 states regarding lawsuits against engineers and architects.
Obtained favorable ruling from Court of Appeals in Tyler regarding the Statute of Limitations in Insurance Policy.
Obtained favorable summary judgment in property/bad faith lawsuit, resulting in dismissal of all bad faith claims.
Obtained federal court summary judgment on behalf of property insurer dismissing all claims and causes of action due to insured’s failure to segregate damages under the concurrent causation doctrine.
Obtained favorable ruling from Court of Appeals in Tyler regarding the Statute of Limitations in Insurance Policy.
Obtained 91a Motion to Dismiss in state court on behalf of a commercial auto insurer on the grounds that the claimant lacked standing due to claimant’s failure to meet requirements of the additional insured endorsement.
Obtained a federal court ruling granting a Motion to Preclude Attorney’s Fees under Texas Insurance Code §542A.003 pre-suit notice requirements.
Obtained favorable ruling from a Federal Magistrate Judge who granted summary judgment on all claims asserted by the Plaintiff which led to a favorable settlement for a commercial property insurer.
Represented and advised various personal and commercial property insurers regarding legal issues unique to policies’ appraisal clause.
