Christy Culver represents clients in insurance coverage and bad faith matters and is Board Certified in Texas Insurance Law. She provides guidance for coverage and bad faith disputes through each phase of resolution, including pre-litigation coverage analysis, strategic discovery, motion practice, alternative dispute resolution, trial strategy, and the appellate process.
She focuses her practice on complex, multi-party insurance coverage litigation and bad faith litigation concerning general liability, directors & officers/errors & omissions, environmental, construction, professional liability, and accident and health coverage.
Christy is licensed in Texas and Louisiana and handles coverage litigation in jurisdictions across the United States.
Christy is recognized in Chambers USA for Texas Insurance, The Best Lawyers in America – Insurance Law, and as a Super Lawyer – Rising Star in Texas and Louisiana.
She is a member of the Council for the Insurance Law Section of the State Bar of Texas, and is a Fellow of the American Bar Foundation, Texas Bar Foundation, and Louisiana Bar Foundation. She speaks regularly about insurance coverage matters on a national basis.
Background
Christy is the former Vice President for the Houston Chapter of CLM and the current chair for Region 7. Christy regularly speaks on coverage issues at the national level, including the ABA’s Insurance Coverage Litigation Committee Seminar, the Advanced Insurance Law Seminar sponsored by the State Bar of Texas, and CLM’s national conferences.
Representative Experience
Obtained favorable order in the Southern District of Texas holding that an insurer has no duty to indemnify underlying bodily injury claims arising out of benzene based on a pollution exclusion.
Obtained grant of application for supervisory writ before Louisiana First Circuit court of Appeal and reversal of trial court’s denial of insurer’s summary judgment motion on weapons exclusion and assault & battery exclusion.

Obtained reversal of an order granting class certification for claims arising out of an explosion at a weapons demilitarization plant and the subsequent recommended evacuation of an area around the plant.

Obtained dismissal of Chinese Drywall product defect suit in Louisiana based upon Peremptory Exception of Peremption.
Obtained summary judgment in favor of insurer on multiple environmental property claims and bodily injury claims in the Western District of Louisiana.
Obtained favorable opinion, in construction defect case, by the Fourth Circuit Court of Appeal of Louisiana reversing trial court’s judgment granting motion for new trial and reinstating an order of dismissal on the grounds of abandonment.

Obtained partial summary judgment, in the United States District Court for the Southern District of Texas, dismissing claim against insurer for pre-tender defense costs, and third-party’s claim for breach of the insurance policy because the third-party lacked standing.
Obtained favorable order defeating a Motion to Dismiss in the Northern District of Texas holding that injured parties are appropriate defendants in federal declaratory judgment actions brought by insurers even if they have not yet obtained a judgment against the insured.
