The Fifth Circuit affirmed the dismissal of a bad faith suit that Thompson Coe attorneys handled in the Western District of Texas. The plaintiff, an Iraqi citizen, claimed that his employer, a large military contractor, conspired to deprive him of comp benefits after he was injured in an explosion while working as an interpreter imbedded with an army unit in Iraq. The Fifth Circuit agreed that the plaintiff’s claims were barred by the exclusivity provision of the Defense Base Act which governs the payment and administration of comp benefits for overseas workers.
