Claims personnel will also learn the impact of the recent Menchaca decision addressing the insured’s right to recover policy benefits as statutory damages under §541.060 of the Texas Insurance Code as “actual damages” in certain instances and when such a recovery is not allowed. Claims personnel will also learn of the questions that remain open regarding potential exposure under §541.060.
