PC Webinar: Update on Storm Litigation: Hurricane Harvey and Chapter 542A, and Current Challenges to the Appraisal Process
This webinar will address the status of Hurricane Harvey litigation 18 months on, including current Court-sponsored discovery control orders proposed to govern initial discovery of Hurricane Harvey and other natural disaster claims, and efforts of the plaintiffs’ bar to consolidate Harvey litigation for pretrial handling. We will also address the impact and application of Chapter 542A 18 months after its effective date, including notice, inspection, and abatement provisions and election of legal responsibility. In addition, we will discuss current challenges to the contractual appraisal process, including the pending challenges before the Texas Supreme Court in Ortiz v. State Farm Lloyds and Barbara Technologies v. State Farm Lloyds. Those cases involve the question of whether an insurer’s timely payment of an appraisal award bars an insured’s contractual and extracontractual claims, including claims under the Prompt Payment statute.
