Thompson Coe Attorneys Prevail in Appeal Before US Court of Appeals

Thompson Coe attorneys recently represented the prevailing party in an appeal before the United States Court of Appeals for the Fifth Circuit. The appeal presented the question of whether a major insurer’s settlement payment on behalf of its insured was covered under its employer’s liability policy. The insured appealed the district court’s judgment awarding Thompson Coe’s client the money that it had paid on behalf of its insured to settle underlying litigation. The Fifth Circuit agreed that the payment was properly allocated to the uncovered claim and affirmed the district court’s judgment.
