After a jury trial in federal court, Thompson Coe attorneys, representing a major insurance company group, obtained a verdict reallocating damages in a construction related matter to another insurance carrier that had denied defense and indemnity. The federal court previously ruled on motions for summary judgment that the defendant carrier had breached its duty of defense and that the issues presented were distinguishable from those presented in Mid-Continent v. Liberty Mutual.
