Austin partner Natalie Tarnosky obtained a summary judgment and full dismissal in a first-party case arising from Winter Storm Uri.

This case arose from Winter Storm Uri and involved a post-appraisal award of $28,000, which was rejected by the insurance company as the carrier had already paid its $5,000 special limit for water damages. The Plaintiff was advised that any appraisal award would be rejected, but pursued appraisal anyway with no resolution reached between the carrier and Plaintiff. The judge agreed that no additional benefits were owed under the policy and granted the motion just three weeks after it was filed, and just a month before trial.
