Brian Martin, partner in the Houston office, will participate in a webcast sponsored by the Texas State Bar and entitled “Triple Play: Three New Texas Supreme Court Insurance Decisions.”  In addition to moderator James Cornell of Cornell & Pardue and faculty members Michael W. Huddleston of Shannon Gracey Ratliff & Miller and Lee Shidlofsky of Visser Shidlofsky, Mr. Martin will discuss three significant insurance decisions issued by the Texas Supreme Court concerning trigger, "bodily injury" and whether coverage can be expanded by waiver or estoppel.  In Don's Building Supply, Inc., v. OneBeacon Ins. CoZurich American Ins. Co. et al v. Nokia and Related Cases, and Ulico Cas. Co. v. APA, the Court grappled with a number of hot emerging issues, such as:

  • What is the appropriate trigger for "property damage"? Manifestation? Exposure? Injury in fact?
  • Does alleged "biological injury" constitute "bodily injury" and trigger the duty to defend?
  • Does the Wilkinson exception to the general rule that you cannot create coverage by estoppel still apply?
  • What do these opinions say about the direction that the Texas Supreme Court is taking in deciding insurance cases?
