UM/UIM Claims Handling: Is There A New Bad Faith Standard?

Upon completion of this course, attendees should have an understanding of the standard outlined in the Burgess opinion as it applies to causes of action for common-law bad faith and under the Texas Insurance Code in connection with a claim for (“UM/UIM”) coverage.
Also, at the end of the course, attendees should understand the various standards applied by other intermediate courts of appeals, as well as the Texas Supreme Court, in handling claims for UM/UIM benefits. Lastly, attendees should be aware of the issues presented in handling claims for UM/UIM benefits under Burgess, as well as under other standards adopted by other intermediate courts. This includes an understanding regarding the issues involved under Burgess in responding to demands to settle, investigating UM/UIM claims and communicating with insureds.
