The Good, The Bad, The Ugly: Texas Appraisals

The purpose of this presentation is to provide an overview of insurance appraisals in Texas. The presentation will provide a brief history of the appraisal clause’s use in Texas, and will then explore several recent decisions by the Texas Supreme Court that have affected the rules applicable to appraisal clauses. The presentation also includes a lengthy discussion of the practical aspects of these decisions, including whether the appraisal is mandatory, the scope of what appraisers can consider, and whether appraisal awards can and should be challenged.
