Primer on Admiralty and Maritime Claims with Recent Maritime Law Developments from the U.S. 5th Circuit

This presentation will provide those in attendance with an understanding of admiralty and maritime personal injury claims. It will discuss the differences between state workers’ compensation laws, the Longshore Harbor Workers’ Compensation Act (LHWCA), the federal Jones Act and General Maritime Law. It will provide the those in attendance with an understanding of which type of employee has an actionable remedy under either law, the defenses to those remedies available to the insurer/ship owner and the type of remedy the Plaintiff can seek depending on which law their claim may fall under. It will discuss recent opinions out of the U.S. 5th Circuit on these issues and conclude with a discussion about how to assist a vessel owner to avoid and/or mitigate Maintenance and Cure claims.
