This presentation will educate attendees regarding the ins and outs of affidavits and counter-affidavits under section 18.001 of the Texas Civil Practice and Remedies Code.  This discussion will include an update of Legislative changes to the statute in 2019, and will provide an overview of a few key cases that set the stage for the varying and conflicting approaches trial courts have recently taken in resolving 18.001 issues. The final portion of the presentation will focus on counter-affidavit best practices and suggest a useful process and safeguards to implement in cases where the plaintiff seeks past medical expenses.
