Kevin Parish is an experienced trial and appellate attorney representing insurance carriers in coverage matters and bad-faith litigation in Texas and New Mexico.

He has handled matters under general commercial liability and excess policies, professional liability policies, pollution policies, D&O policies, and life, accidental death, and disability policies. He has experience analyzing Stowers and Hamel doctrine issues and regularly analyzes risk-shifting mechanisms such as indemnity agreements and using additional insured requirements in contracts.

Kevin is a creative problem solver, an energetic and strategic leader, and a gifted written and oral communicator who looks forward to navigating coverage issues and other insurance-related challenges for his clients.

Representative Experience

Obtained a favorable Texas Supreme Court opinion holding that a settlement agreement between certain directors and officers of a corporation and the corporation’s shareholders was inadmissible and not binding in order to establish coverage under the applicable D&O policy because the settlement was not the result of a “fully adversarial trial.”

Obtained summary judgment for insurer of trucking broker because insured was not a “motor carrier” under the FMCSRs.

Obtained an appellate decision affirming a favorable grant of summary judgment for insurer in a premises liability case.

Obtained summary judgment (and successfully defended judgment on appeal) for liability insurer based on exclusion in policy for false statements made on insurance application.

Obtained summary judgment for UIM insurer when claimant had not established his legal entitlement to recover from the underlying defendant-driver.

Obtained a dismissal on behalf of a commercial insurer based on claimant’s failure to comply with certain provisions of Texas’ Pandemic Liability Protection Act (PLPA).
