Thompson Coe Attorneys Receive Favorable Verdict for Insurance Company

Daniel Buechler and David Taylor, from the Dallas office, represented an insurance company in a suit by a former policyholder for breach of contract, breach of the duty of good faith and fair dealing, and violations of the Texas Deceptive Trade Practices Act and Texas Insurance Code arising from the denial of an insurance claim following a residential house fire. The Plaintiff claimed over $215,000 in contract damages and up to $750,000 in exemplary damages and attorney fees. Following the close of evidence, the Dallas County judge issued a directed “take-nothing” verdict on Plaintiff’s contract damages, after which Plaintiff’s remaining extra-contractual claims were also dismissed.
