Jury Verdict Obtained in $25M Wrongful Death Suit

HARRIS COUNTY, TX (February 26, 2019) Thompson Coe Partner David McFarland obtained a defense verdict on behalf of our client, Bil-Jax, Inc., in a $25 million product liability, wrongful death action.
The lawsuit arose from a May 3, 2017 scaffolding incident in which the decedent fell approximately 15 feet from a scaffold, sustaining fatal injuries. Plaintiffs alleged that Bil-Jax, Inc.’s scaffolding was defectively designed and/or marketed.
After a one week trial, the jury found that Bil-Jax, Inc.’s scaffolding was not defectively designed and/or marketed and found Bil-Jax, Inc. 0% at fault. The jury found that decedent’s actions were the producing cause of decedent’s death and found decedent 80% at fault. The jury also found Co-Defendant, Sunbelt Rentals, 20% at fault.
The case is Imelda Grajales v. U.S. Carpet & Floors, et. al.
