Brian Martin, partner in the Houston office, will participate in a web cast sponsored by the Texas State Bar and entitled “ No Prejudice, No Harm: The Supreme Court Takes on Conditions Precedent and Allocation of Settlement Among Carriers.”  `Along with co-panelists Robert Cunningham, Veronica Bates, and Jim Cornell, Mr. Martin will discuss the opinion, its ramifications, and what this may mean for other cases currently pending before the High Court. They will also discuss the recently issued Mid Continent v. Liberty Mutual opinion and its ramifications on settlement in cases involving multiple carriers.

    • Is there a difference between breach of a ‘covenant’ or ‘condition precedent’ anymore?
    • What constitutes material breach & prejudice from late notice?
    • What is material to the contract bargain for an insurance policy?
    • Can prejudice be decided as a matter of law?
    • Does PAJ’s ruling apply to notice under claims-made policies?
    • Consent to settle provisions: material breach of condition precedent or waived as a conflict of interest?

The discussion will broadcast from 10:00 a.m.  to 11:30 a.m. and recipients will receive 1.5 hours MCLE credit.  To sign up, call 800-204-2222 or go to http://techsupport@texasbarCLE.com.
