Biography

A trial lawyer with over 35 years’ experience, Bob Latham represents insurers in bad faith claim handling cases, policy rescissions and cancellations, lost policy matters, and drafting policy exclusions. He also represents reinsurers in investigation of ceded claims and in ceding company liquidations.  In non-insurance matters, he has represented defendants in asbestos cases and public entities in wrongful death, catastrophic bodily injury, and property damage cases. He has also represented clients in corporate dissolutions, business tort cases, trade infringement cases, securities arbitrations, and corporate raiding matters.

Bob’s practice also includes representing travel providers and insurers on health, accident, life, disability and property losses. A frequent and sought-after speaker, Bob addresses insurers on claim handling and special investigative unit certifications.

Representative Experience

Bob won a 12-0 jury defense verdict for a major California property insurer in a homeowner's breach of contract and bad faith claim handling case, after a trial demand of $998,000 and an offer during trial of a waiver of costs in exchange for dismissal. The client was awarded $86,000 in costs.

Bob has won a $14.4 million products liability, wrongful death judgment for a widow and her two children against a foreign company served under the Hague Service Convention.

On behalf of one of his public entity clients, short to mediation or dispositive motion, Bob recently convinced a non-client property insurer to dismiss its $1.4 million subrogation claim action, which did not translate, legally or factually, to any duty owed to its insured by his client.
