Frances M. O'Meara, partner, and Jennifer C. Martin, associate, both from the Los Angeles office, secured a trial verdict on behalf of a law firm and its principal in a legal malpractice case. Plaintiff sued his attorneys handling an underlying rear-end collision personal injury lawsuit for Defendants' failure to file the lawsuit within the statute of limitations. Defendants claimed that Plaintiff suffered no damage because Plaintiff lacked standing to sue on the personal injury lawsuit due to the fact he had filed for bankruptcy protection and failed to schedule the suit as an asset. Defendants also contended that Plaintiff's claimed injuries did not arise out of the automobile accident. The jury agreed that Plaintiff suffered no damages in the underlying automobile accident and rendered a defense verdict.
