Biography

Kelly Almeter devotes her practice to the representation of insurers, adjusters, and vendors in a wide variety of matters.  She has been involved in several noteworthy first party property cases involving appraisal, breach of contract and extra-contractual claims of bad faith as well as Texas Insurance Code and DTPA violations in both state and federal court.  She also represents numerous carriers, including primary, umbrella and excess insurers, in coverage-related litigation and advises insurers on coverage issues under E&O, commercial liability, auto, property and homeowners’ policies.

Representative Experience

  • Represented insurers in judicial proceedings involving appraisal.
  • Negotiated favorable settlements in cases involving Breach of Contract, Insurance Code and DTPA violations and other bad faith claims against Texas insurance companies and adjusters in commercial and residential cases filed in difficult venues.
  • Obtained favorable rulings in relation to various plaintiffs’ motions to remand based upon the fraudulent joinder of a state, resident insurance adjuster.
  • Negotiated favorable settlements in coverage-related disputes involving business risk and employer liability exclusions in commercial general liability policies.
  • Issued advisory opinion to insurer on interpretation of policy language and coverage under commercial and homeowner insurance policies post Hurricane Harvey.
  • Obtained dismissal of breach of contract action and extra-contractual claims in a first party property damage case after successfully asserting Plaintiff did not exercise diligence in timely effecting service of process on insurer, and thus claims were barred pursuant to the policy’s contractual limitations provision.
