On Friday, July 15, 2016, a twelve person jury returned a unanimous defense verdict in favor of Republic Lloyds in the lawsuit styled Bobby and Mary Jane McCoyv.Republic Lloyds, No. 12C1684-202, in the 202nd Judicial District Court, Bowie County, Texas. In that case, Republic Lloyds insured the McCoys’ home in Texarkana, Texas which allegedly sustained foundation damage due to plumbing leaks. Upon investigation, Republic Lloyds determined that the wood comprising the pier-and-beam foundation suffered from rot that occurred over a period of time due to a number of factors, including poor ventilation within the crawlspace. Republic Lloyds denied the claim, and the McCoys retained Speights and Worrich law firm and filed suit alleging both contractual and extra-contractual causes of action. After a week-long trial in which multiple witnesses were called to testify, the jury found that plumbing leaks were not the sole cause of the damage to the McCoys’ home, resulting in a defense verdict.
