This presentation will discuss the impact of two recent Texas state court decisions on how claims are settled and paid by insurers to co-payees. One case, McAllen Hospitals v. State Farm, 433 S.W.3d 535 (Tex. May 16, 2014), addressed a hospital lien governed by Chapter 55 of the Texas Property Code. The other case, Viewpoint Bank v. Allied Ppty. & Cas. Ins. Co., No. 05-12-01370-CV, 2014 WL 3867810 (Tex. App.—Dallas Aug. 7, 2014, pet. filed), expanded upon McAllen Hospitals in the context of More...an insurer paying co-payees on a homeowners’ property claim. The cases have put in flux how an insurer effectively settles a claim with finality when co-payees need to be paid pursuant to the settlement.
