
A new claim/lawsuit arrives: which insurance covers it? Determining whether state workers’ compensation, the Longshore and Harborworkers’ Compensation Act, or the Jones Act, applies to a new claim or lawsuit is usually the first question to be answered in the claims handling process. This presentation provides the statutory and legal definitions of what constitutes a claim under each of the three compensation schemes, with a focus on the Jones Act, and the claims available to a seaman under the General Maritime Law.
