Biography

Ashley Mason’s practice focuses on complex insurance coverage disputes and bad faith claims arising under commercial general liability, professional errors and omissions, property, and excess and umbrella liability coverage.  She is an experienced litigator in both state and federal court and has handled appellate matters in various Texas appellate courts.

She counsels sophisticated insurers in matters involving contractual rights and obligations, extra-contractual claims, and priority of coverage where numerous carriers are involved.  She frequently assists clients with pre-litigation coverage analysis, declaratory judgment actions, alternative dispute resolution, and trial strategy.

Representative Experience

  • Prevailed in Texas trial and appellate court on claims involving personal and advertising injury
  • Prevailed in Texas trial court on claims involving pollution coverage
  • Obtained summary judgment on behalf of insurer in construction defect case involving issues related to the “your product” and “impaired property” exclusions
  • Obtained summary judgment on behalf of insurer in property damage case, resulting in the dismissal of contractual and extra-contractual claims
  • Obtained favorable ruling on motion to remand based upon fraudulent joinder of non-diverse defendant
  • Negotiated favorable settlements of breach of contract, Insurance Code, DTPA, Unfair Insurance Practices, and breach of the duty of good faith and fair dealing claims against insurers
