Houston partner Andy McCluggage obtained a significant victory before an Arbitration Panel appointed by the American Arbitration Association in a construction defect case arising out of a condominium renovation project in Galveston, Texas.

The Panel found that a waterproofing subcontractor’s conduct did not cause the claimed damages to the complex and rejected the general contractor’s third-party claim for indemnity. The Claimant, a condo association, submitted a damage model of over $2 Million, including nearly $500,000 in attorneys’ fees and expenses alone. The arbitration took place in Houston over four days and resulted in a total denial of all claims against our client.
