This course provided insurance agents with an overview of a broker’s liability in Texas, and how that duty is expanding. The course covered an insurance agent’s common-law duty and statutory liability under the DTPA and Insurance Code, and what duty is owed by a broker determined to be in a “special relationship” with an insured. The course provided information as to how courts have determined that a special relationship exists between the insurance agent and insured. Additional focus was spent on recent caselaw and the impact of those decisions on the interpretation and refinement of the law. Upon completion of this course, the insurance agent should know what duty is owed to an insured, and situations that could expand that duty. The insurance agent should know an overview of the various theories of liability that could be brought against the agent in Texas.
