Claire Wiswell is a civil litigator that represents clients in litigation matters involving business torts, premises liability, construction defects, contract disputes, wrongful death, products liability, labor and employment issues, healthcare liability, medical malpractice, and business disputes. She has experience in all aspects of civil litigation, including depositions, complex discovery, mediations, trials, and arbitrations.

Claire is licensed in both the State of Texas and the State of New Mexico.  She has successfully represented individuals and companies in state and federal courts including developing pre-trial and trial strategy, arbitration, advising clients on regulatory compliance, negotiating settlements, and preparing clients for all stages of litigation.

  • Obtained federal court summary judgment on claims against parent companies of industrial plant
  • Obtained dismissal of dram shop case on behalf of homeowners relating to provision of alcohol to guest
  • Obtained summary judgment on behalf of industrial company involved in wrongful death claim
  • Obtained defense verdict for automobile repair business in case involving breach of contract claims arising out of damage to multiple vehicles from weather events
  • Attended trial resulting in successful verdict in explosion/gas tank burn case
  • Defeated summary judgment against property owner in trespass claim arising out of allegations of environmental hazards and nuisance
  • Obtained multiple dismissals in construction cases involving general contractor–subcontractor injuries from on-the-job claims
  • Obtained dismissal of medical malpractice case through successful motion to dismiss in case involving pre-employment screening
  • Successfully negotiated favorable settlements in numerous cases involving premises liability, contracts, and automobile/trucking accidents
  • Represented and advised contractors and subcontractors on employer–employee relationship issues
  • Prepared clients for HIPPA audits; consulted on clients’ protocols in place to ensure HIPAA compliance; assisted in workplace investigations pertaining to healthcare violations
  • Represented and advised employers in litigation matters involving allegations of wage violations, discrimination, retaliation, and wrongful termination
