Overview

Jodee McCallum practices in the areas of employment law defense, professional liability defense, commercial litigation, and corporate discovery. 

Jodee represents management in labor and employment disputes and litigation, utilizing the 10+ years of human resources management experience she had prior to going to law school. She defends employers before the Equal Employment Opportunity Commission (EEOC), the Minnesota Departments of Human Rights (MDHR), local agencies, the Minnesota Unemployment Insurance agency (UI), and in Minnesota courts. She also works with clients to develop and maintain employment policies and handbooks, conduct workplace investigations, and draft various employment agreements.

In addition, Jodee advises corporate clients on discovery issues such as document preservation programs, document reviews, electronically stored information, written discovery, and other aspects of the discovery phase in complex litigation. She had more than 10 years of discovery and project management experience prior to attending law school.

Prior to joining Thompson Coe as an attorney, Jodee was a business consultant at another law firm and the Chief Executive Officer of a multi-million dollar corporation in the Twin Cities. In these roles, she maintained business compliance with state and federal regulatory agencies, created and implemented corporate policies and procedures, business plans, and corporate agreements. She has assisted clients in trademark applications, business formations, financial defaults, business dissolutions, and membership interest sales. She has also structured business acquisitions, sales, and leasebacks, and has negotiated and prepared dozens of business and employment agreements along the way. 

Jodee is currently a Board Member for a private for-profit corporation and for a non-profit corporation, both based in Minnesota. She is also a qualified ADR neutral registered with the Minnesota Supreme Court under Rule 114.

Representative Experience
  • Following a two-week trial, obtained defense jury verdict on behalf of large, privately held, Minnesota-based international dairy and food processing company on sex discrimination, retaliation, and intentional infliction of emotional distress allegations made by the company’s former in-house counsel. (2011)
  • Obtained summary judgment in favor of foodservice employer, where employee alleged discriminatory pay practices and hostile work environment on the basis of race. (2010)
  • Obtained summary judgment in favor of the officers and directors of a nonprofit client in lawsuit alleging torts, including defamation, fraudulent misrepresentation, intentional infliction of emotional distress, and conspiracy. (2010)
  • Defended judgment in favor of client on plaintiff's appeal to the Minnesota Court of Appeals. (2011)
  • Obtained summary judgment in favor of nonprofit client in district court lawsuit filed by independent contractor alleging breach of contract and implied covenants, unjust enrichment, and defamation. (2011)
  • Obtained the dismissals of several EEOC and Minnesota Department of Human Rights complaints against employers, including allegations of discrimination based on race, disability, national origin, age, and gender; retaliation and reprisal; sexual harassment; and reasonable accommodations.
  • Negotiated, mediated, and obtained favorable settlements on behalf of employers representing many industries, including: law firms, hospitality, foodservice, healthcare, nonprofits, and government service.
