Jenny Burke’s litigation practice focuses primarily on labor and employment law and general civil matters.  Her extensive labor and employment experience includes defending companies of all sizes against claims of wrongful termination, discrimination, harassment, retaliation, and wage and hour violations in California and Federal Courts, as well as arbitration proceedings.  She has handled numerous administrative claims originating with the EEOC and Department of Fair Employment and Housing.  Her experience also includes defending a broad range of clients, such as real estate brokers, insurance brokers, and attorneys against claims of fraud, breach of contract, and breach of fiduciary duties.

Representative Experience
  • Obtained summary judgment on behalf of a national document management services company in an employment discrimination matter involving claims of discrimination based on race and national origin, harassment, retaliation, and breach of contract
  • Obtained successful resolution of claims against a residential care facility of violations of California and Federal wage and hour laws
  • Resolved numerous matters involving claims of discrimination, harassment, and wrongful termination on a cost-effective pre-litigation basis before the claims were filed in court
  • Obtained dismissal of wage and hour claims brought in a California federal court by a caregiver against a residential care facility
  • Obtained a successful outcome for a real estate agent against claims of fraud and breach of fiduciary duty
  • Successfully opposed a motion for reconsideration of summary judgment of claims involving discrimination and harassment based on race, gender, and national origin
