Overview Eric Bowers’ practice focuses on insurance coverage, priority and allocation disputes and bad faith litigation related to commercial general liability, commercial auto liability, professional (E&O) liability, and excess and umbrella liability coverage. Eric counsels primary and excess insurers in these areas and represents their interests in state and federal court. He has substantial experience evaluating trigger, allocation, additional-insured and “insured contract” issues in a variety of industries, including construction, oil-and-gas, trucking, and real estate brokerage and mortgage services. |
Representative Experience
- Defended commercial general liability insurer against third-party suit brought by named insured’s consultant asserting bad faith, Texas Insurance Code and Deceptive Trade Practices Act violations (state court).
- Obtained jury verdict for commercial general liability insurer against subsequent insurer of mutual insured in action to recover settlement payment and defense costs arising out of underlying construction defect lawsuit (federal court).
- Defended commercial general liability insurer in declaratory judgment action brought by another insurer to determine the insurer’s duty to defend in an underlying construction defect lawsuit (federal court).
- Represented primary and umbrella carrier in construction defect lawsuit involving allocation and trigger of multiple policy layers and years of coverage (state court).
- Defended liability insurer in declaratory judgment action to determine whether staffing company worker was an “employee” of insured client company within the meaning of that term in commercial general liability policy (federal court).
- Represented insured in declaratory judgment action brought by commercial general liability insurer involving novel issues concerning pollution exclusion and coverage (federal court).
