Overview

Diana Brown practices in the area of insurance coverage, bad faith, and general litigation and has experience with energy-related and marine risks. She has represented clients in coverage disputes and litigation involving numerous types of insurance policies, including well control, offshore and onshore construction, pollution liability, offshore and onshore property, business interruption, commercial general liability, marine general liability, professional liability, directors’ and officers’ liability, builders’ risk, political risk and excess lines.

In addition, Diana has experience in complex, multi-party insurance coverage litigation and subrogation claims.

Representative Experience
  • Represented insurers in resolution of over $300 million in claims resulting from offshore property damage and loss of production caused by Hurricanes Katrina and Rita.
  • Represented insurers in resolution of $400 million claim resulting from refinery explosion.
  • Represented insurers in $50 million coverage dispute in Texas state court against professional liability claim by accountants involving failed investment scheme.
  • Represented London underwriters who insured certain investments by Enron and others in Enron bankruptcy.
  • Represented London insurers in a $25 million dispute with a Houston oil and gas operator which arose from a political risk policy.
  • Defended longshoreman’s LHWCA claim and enforcement of contractual indemnity provisions, including appeal to the Fifth Circuit Court of Appeals.
  • Represented insurer in $40 million insurance claim arising out of destruction of an oil well resulting in well being plugged and abandoned, including multi-party subrogation action.
  • Represented insurers in multi-million dollar dispute over coverage under Builder’s Risk policy.
  • Represented domestic and London underwriters against claims concerning physical damage, loss of hire, loss of production, failure to launch, control of well, and removal of debris issues arising from claims against all-risk marine energy policies.
  • Represented insurers in Texas in construction defect litigation concerning physical damage under commercial general liability policies.
