Overview Alix K. Cornett represents primary, excess, and umbrella insurers in coverage and bad faith claims involving construction defect, products liability, and directors and officers issues, as well as asbestos and silica litgation filed pursuant to the direct action statute in Louisiana. She has coverage experience in complex, multi-party insurance coverage litigation and in disputes involving commercial general liability, business and personal auto, homeowners, group accident, worker's compensation/employer's liability, and commercial property policies. Her practice focuses primarily on insurance coverage and defense, including the defense of claims for breach of contract, bad faith, and violations of the Texas Insurance Code and Deceptive Trade Practices Act.
Prior to joining Thompson Coe, Alix served as Judicial Law Clerk to the Honorable Arlene R. Lindsay in the United States District Court for the Eastern District of New York in 2006 and as Judicial Law Clerk to the Honorable Henry R. Wilhoit, Jr. in the United States District Court for the Eastern District of Kentucky in 2005. |
Representative Experience
- Obtained summary judgment for insurer in declaratory judgment action seeking determination that insurer had no duty to defend or indemnify the insured under the "personal and advertising injury" coverage of the policy based on underlying patent infringement claims.
- Obtained summary judgment for mountain climbing gear manufacturer on failure to warn claim and defective design claim (involving an issue of first impression) under the Louisiana Products Liability Act.
- Obtained two summary judgments for over-the-counter drug company based on federal preemption despite unsettled law regarding the applicability of the doctrine to the federal product labeling provisions at issue.
- Drafted numerous coverage opinions for primary and excess insurers analyzing standard as well as novel and complex coverage issues.
